WHAT WE DO
In representing you on your purchase or sale we, in essence, act in the role of quarterback to ensure, as much as is within our power, that the transaction closes on time. We protect buyers to ensure that upon the payment of the purchase price they receive good title to the property and that the sellers comply with their obligations. We protect sellers to ensure that they do not lose title without payment of the purchase price. This requires us to effectively communicate with all parties involved, conduct a number of different searches and take a number of steps some of which include:
- review the contract and mortgage instructions (if applicable) upon receipt
- conduct title, property tax, community fee and other searches.
- prepare the Statement of Adjustments calculating the balance owing on closing
- for sellers obtain payout information on mortgages and other financial liens
- for buyers calculate their cash requirement to close and assist with the funding of any bridge
financing - prepare various closing documents including transfers of land, tenancies at will, mortgages,
directions to pay, etc. - arrange a meeting with a lawyer (usually Lou) for the execution of the closing documents
- in representing sellers obtain an RPR with Compliance (if applicable) and for condominiums an
Estoppel Certificate - send out a trust letter to the buyer’s lawyer or review the trust letter received from the seller’s
lawyer as the case may be
- negotiate required amendments to trust conditions with the other lawyer
- in representing buyers coordinate the funding of the mortgage and bridge financing
- communicate with the client’s Realtor to verify satisfactory pre-possession inspection
- forward closing funds to the seller’s solicitor to secure release of keys and submit transfer
documents to land titles for registration - on the selling end pay out any mortgages on title, pay commissions on the transaction and deposit
net sale proceeds into the client’s bank account - in due course obtain and register discharges of mortgages at the land titles office and report to
the buyer’s lawyer - both lawyers provide interim reports to their respective clients roughly 3 weeks post-closing and
for buyers a final report with a clear title is provided roughly two to three months post-closing
